Terms of use

1. Provider and scope
Crewtender is a service of Benjamin Schiffer, WP Digital Ranger (“we”). These terms apply to all firms and persons who use Crewtender (“customer”). Crewtender is aimed exclusively at entrepreneurs within the meaning of § 14 BGB (German Civil Code).
2. Service
- Every day Crewtender searches for public tenders according to the customer's search profile, rates them and writes fact sheets from the public notice. In addition there is a workspace for staff, deployment planning, time recording, invoicing, customers and team chat. Functions based on German law (e.g. payroll, premiums, invoices, VAT) are available only for firms in Germany; they do not replace a check by a tax adviser or payroll accountant.
- The customer can upload tender documents. From these Crewtender writes a detailed fact sheet and helps with costing.
- Firms can store certificates and their own templates, edit bid drafts and download a bid folder. Bid versions must be approved by the firm's management before download. Submission is made by the customer via the channel provided by the contracting authority; creating or downloading a folder is not a submission. A receipt uploaded afterwards documents the submission reported by the customer.
- Crewtender does not itself download tender documents from portals whose terms prohibit this. The customer does the download personally via the link to the portal.
3. AI and no warranty
Ratings, fact sheets and cost calculations are produced by an AI. They may be incomplete or wrong. Only the original documents of the contracting authority are authoritative. Before every bid the customer checks deadlines, requirements and prices personally. Crewtender is not legal or tax advice. We do not guarantee that Crewtender finds every suitable tender.
4. Obligations of the customer
- The customer uploads only documents that it is entitled to use and observes the terms of the procurement portals.
- The customer is responsible for the data it enters about its staff, its applicants and customers and informs these persons (Art. 13 GDPR). It does not enter health data or other special categories (Art. 9 GDPR) or criminal record data (Art. 10 GDPR) in free-text fields. It uses functions that can evaluate the performance or behaviour of employees (e.g. time clock, ratings, patrols) only to the extent permitted for it; where there is a works council, it observes the works council's co-determination rights (§ 87(1) no. 6 BetrVG).
- Access credentials are personal. The customer invites only people who work for it and removes them when they leave.
5. Prices
We agree prices and the package separately with each firm. During a preview or trial period Crewtender is free of charge; a trial period ends automatically without a paid package starting. For trials the volume of AI evaluations may be limited. Prices are exclusive of VAT, where applicable.
6. Availability
We strive for trouble-free operation but do not owe any particular level of availability. Maintenance and faults at service providers may lead to interruptions.
7. Liability
We are liable without limitation for intent, gross negligence and injury to life, body or health. In the case of simple negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable, typical damage and at most to the remuneration for the last 12 months. In the case of free use (preview, trial period), we are liable, applying § 521 and § 599 BGB mutatis mutandis, only for intent and gross negligence, and therefore not for simple negligence. The first sentence remains unaffected in all cases. We are not liable for simple negligence for missed deadlines, tenders not found or lost tender procedures, insofar as they are based on information from the AI which the customer must check personally under section 3.
8. Data protection
Insofar as we process personal data on behalf of the customer, the data processing agreement applies. More in the privacy policy.
9. Term and termination
Either party may terminate at any time with effect from the end of the month, unless otherwise agreed. Until the end, the customer can download its data (e.g. archive of all invoices and receipts, hours, payroll list). After the end we delete the firm's data within 30 days; it disappears from the encrypted backups after one year at the latest.
10. Final provisions
German law applies. The place of jurisdiction is, to the extent permitted, our registered office. We announce changes to these terms by email. Changes that do not put the customer in a worse position or only concern new functions are deemed accepted if the customer does not object within 4 weeks; we point out this consequence in the notice. Changes to prices or main services require the customer's consent; without consent, either party may terminate with effect from the end of the month.
